Article 1. Equipment

 

FAMILIB hires the proposed equipment to individuals (non-professional) via a network of selected relay withdrawal points acting on behalf of FAMILIB (the “Collection Points”). FAMILIB hires baby equipment for a period of 1 to 28 days within the limits of availability. All the proposed equipment conform to European safety standards and are in good condition.  

 

Article 2. Booking instructions, Prices and conditions

 

Option number 1: hire on the website at www.familib.com

1. In this case, the Client must fill in or tick the boxes available on the website at www.familib.com following the steps below :

a: the Client chooses the Collection Point,

b: the Client chooses the equipment,

c: the Client chooses the period of hire,

d: the Client pays the due amount on-line.

2. The prices are the one mentioned in “OUR PRICES” section on the www.familib.com Website. The prices are 30% less than when the Client hires the equipment directly at the Collection Points. The prices may be modified at any time by FAMILIB without prior notice.

3. The Client must pay the due amount on-line with a bank card.

The payment by the Client means that he has read and that he agrees to the Hire Agreement. The Hire Agreement comprises the present general Terms and Conditions as well as the specific Terms and Conditions chosen when the Client books on-line on the FAMILIB Website, and, as the case may be, some other specific Terms and Conditions mentioned on the withdrawal voucher.

4. According to French laws and regulations, the Client has a 7 days retraction period. If the 7th day is a Saturday, a Sunday, a bank holiday or a national holiday, then it will be deferred to the following working day. The retraction period starts from the moment the Client pays the due amount on-line. 

By way of exception, the retraction period is not possible if the period of hire starts within 7 days.

Under no circumstances, once the retraction period is over, can the booking be cancelled; the full due amount is therefore payable to FAMILIB.

5. On the withdrawal day, the Client must :

1. complete and sign the withdrawal voucher,

2. have read the rules of safety and usage of the chosen equipment, available on Internet www.familib.com and at every Collection Point, being noticed by the Client agrees by the present Terms and Conditions to respect all and any of these rules,

3. pay the following deposit, as the following equipment will only be handed over if the deposit is paid:

. for a three wheels, Easy Walker Sky pushchair: 250 euros,

. for a four wheels, Maclaren Quest pushchair: 150 euros,

. for a Joie car seat: 150 euros,

. for a NUNA travel bed : 100 euros,

. for the Lafuma baby carrier: 50 euros.

6. When the Client returns the equipment, the Collection Point and the Client must fill in the “Condition after” box on the Hire Agreement. 

In this respect, if the Client does not:

- return the equipment, for whatever reason, or

- bring the equipment damaged or broken,

the Client then will be charged the whole amount of the deposit.

If the equipment is dirty or slightly damaged, the Client will be charged part of the deposit amounting to 20 euros for each problem.

If the Client is late to withdrawal the equipment, the equipment will be made available to other Clients. If the Client brings the equipment back late, the Client will have to pay a penalty amounting to 15 euros per day late; any day started will then be due in totality, but there will be a 30 minutes free period of tolerance starting from the stated time of equipment return. This penalty amount will be, if the Collection Point deems it necessary, debited from the deposit money.

If the Client brings the equipment back early, the Familib’ Collection point is not obliged to refund some Clients’ money. However, depending on the context, the Collection point can make a commercial gesture towards the Client.

 

Option number 2: the Client hires the equipment directly at the Collection Point without booking on Internet at www.familib.com

1. In this case, the Client must go directly to the Collection Point.

If the equipment is available for the desired period of hire, the Client can sign the Hire Agreement directly at the Collection Point.

2. The applicable prices in this case are the one mentioned in the “OUR PRICES” section on the www.familib.com Website plus 30%. The prices may be modified at any time by FAMILIB without prior notice.

3. The Client must pay the due amount directly to the Collection Point. 

4. The Client cannot, for any reason, cancel the Hire Agreement. 

If the client cannot withdrawal the equipment, then the full due amount must still be paid to FAMILIB.

5. The Client will only have access to the equipment when he:

a.  has duly completed and signed the Hire Agreement,  

b.  has paid the corresponding due amount,

c.  has read and agreed to the rules of safety and usage of the chosen equipment available on Internet at www.familib.com and at every Collection Point,

d.  has paid the following deposit to the Collection Point:

- for a three wheels, Easy Walker Sky pushchair : 250 euros,

- for a four wheels, Maclaren Quest pushchair : 150 euros,

- for a Joie car seat : 150 euros,

- for a NUNA travel bed : 100 euros,

- for the Lafuma baby carrier : 50 euros.

- does not return the equipment, or,

This amount will be, if the Collection Point deems it necessary, debited from the deposit.

Article 3. Hire period – Loyalty card

 

3.1 Once the hire period is booked, it is permanent.

- in Option n° 1 above: on www.familib.com,

- in Option n° 2 above: in the Hire Agreement at the Collection Point

In all cases, the due amount must be paid for the entire period of hire whether the Client does not withdrawal the equipment, withdrawals the equipment up late or brings the equipment back early.

3.2. By hiring the equipment on ten consecutive days, the client is allowed to one day free, usable within 360 days starting from the tenth day of hire. 

If the Client wishes to benefit from this offer, then a loyalty card will be handed over to the Client by the Collection Point; the Client must have the card stamped by the Collection Point corresponding to each day of hire. Once the Client has the ten stamps, the Client will benefit from one free day following certain conditions:

- If the Client hires the equipment directly at the Collection Point (option 2), then the Client must bring the card with the ten stamps to the Collection Point and will benefit from one day free (all other Terms and Conditions been applicable).

- If the Client books on Internet (option 1), the Client must pay the due amount, and then write to FAMILIB, including the loyalty card with the ten stamps, and will then receive a bank cheque amounting to 8 euros equivalent to the free day.

A free day does not give right to a stamp on the loyalty card.

 

Article 4: Equipment usage - Responsibility

 

In all cases the Client is responsible for the equipment from the withdrawal time to the drop-off time at the Collection Point (whoever withdrawals or drops-off the equipment).

The equipment must only be used as described in its respective rules of usage booklet, available on Internet at www.familib.com and at every Collection Point, and no other purpose. The Client must read and agree to these rules, and especially the safety rules considering the importance of respecting these rules for the safety of people and things.

The Client must at all times make sure the equipment is safe from theft and damage; the Client must use a theft prevention device, must place the equipment in a safe and clean place and must protect the equipment against rain or snow and from dirt. As a consequence, if the equipment is not handed over in excellent condition, the deposit will not be returned. 

The Client must keep the equipment clean; if the equipment is dirty, the Client must have the equipment cleaned.

The Client will be held responsible for any damage caused by carelessness or if the equipment is used for any other purpose than stated. The Client cannot modify, rearrange or transform the equipment. The equipment must be dropped-off to the Collection Point in the same condition as it was withdrawaled, including all its accessories.

The Client is fully responsible for, and guarantees, the respect of the Terms and Conditions of the equipment on the part of the person(s) and the children(s) who use the equipment.

The Client cannot sell, hire or lend the equipment to other people and must not try and make a profit from the equipment. 

The Client must in all cases drop-off the equipment at the end of the hire period and it cannot be kept or put under sequestration by the Client.

The responsibility of FAMILIB is limited to the agreed amount of the hire and FAMILIB cannot be held responsible for any indirect prejudice undergone by the Client. FAMILIB is not responsible in case of: force majeure (“act of God”), happenings of any nature or any event affecting, delaying or stopping the supply of the hire services.

 

Article 5. Miscellaneous

 

Familib® is a protected trademark property of the FAMILIB SARL Company.

FAMILIB may keep information concerning the Client in the course of its activities; the Client has access and right of modification of personal data according to the laws and regulations in force in France.

The present Terms and Conditions and the Hire Agreements are subject to French law: any litigation will be tried before the French courts within French jurisdiction.
